The bronze sculpture, a rat's head, was  auctioned off on Wednesday night for 14 million euros ($17.92 million) by anonymous telephone bidders in Christie's sale of the collection of Yves Saint Laurent and Pierre Berge in the Grand Palace of Paris. [CFP]

A FRENCH court has rejected the bid by a group of Chinese lawyers to block the sale of a bronze rabbit and rat head. They were looted from China and are to be auctioned in Paris on Wednesday.

The sculptures currently belong to the Yves Saint Laurent Foundation, which put them up for auction. The Chinese lawyers know that the legal process will be difficult, "but we won't give up", said Liu Yang, the chief lawyer.

Q: What's holding back the legal proceedings?

A: The major obstacle is not a new one.

Legal and diplomatic retrieval have been based on international conventions that China signed, the earliest of which took effect in 1970. These conventions cannot be applied retroactively, meaning they apply only to cultural objects stolen or illegally traded after the conventions took effect.

The bronze rabbit and rat head sculptures, however, were taken when the Old Summer Palace was burned down during the Second Opium War in 1860.

Q: What ways are there then to retrieve them?

A: One of the official ways is purchasing, the other one is through diplomatic channels. They can also be returned through personal donations.

Q: Why is it so difficult to get relics back?

A: First of all, there are a lot of legal obstacles. And the international conventions only apply to those who signed them.

In 2002, 18 museums in Europe and the US, including the British Museum and Louvre, made a joint declaration refusing to return artifacts to former owners because they purchased the relics through legal channels.

Also, the relics have been held by the museums for such a long time that the museums claimed they've become a part of the museums, even a part of the countries where the museums are located. This declaration is against the 1970 UNESCO convention.

As for purchasing, since the global relics market lacks sufficient supervision, prices of relics are often extremely high.

Even so, purchasing is the most effective method now, but the Chinese government objects to it.

"To buy them back means we acknowledge they were taken out of our country legally," Song Xinchao, director of the Cultural Heritage Administration's Museum Department, told Guangming Daily.

Finally, China lacks specific procedures for dealing with relics donated by individuals who buy them with their own money. Their rights are not properly respected sometimes. This has a negative effect on donor enthusiasm.

Q: Where are the looted relics now?

A: The Chinese Culture Relics Society estimates that more than 10 million Chinese relics are held in Europe, the US, Japan, and Southeast Asia. Only a few are in museums. Most are held by individuals.
